Labour Market Impact Assessment (LMIA)

A key factor in obtaining an LMIA is demonstrating a genuine need for a temporary foreign worker. This involves proving that no suitable Canadian citizens or permanent residents are available to fill the position.

 

Eligibility Requirements:

  1. Prior to offering the position to a foreign worker, you must advertise the job position for a minimum of four weeks.
  2. Applicants must be legitimate operating businesses that provide goods or services within Canada.
  3. The application must clearly establish the genuine need for foreign workers within your organization.
  4. Applicants should have no unresolved compliance issues with regards to previous foreign worker hires or other relevant employment regulations.
  5. Applicant is required to use at least two recruitment outlets, in addition to the Canadian Job Bank’s website.

Processing Fee :

The LMIA application fee is $1,000 CAD per employee. This fee is non-refundable and is payable upon submission of the application.

CUSMA Work Permits (Canada, US, Mexico)

We are pleased to provide you with a comprehensive overview of the temporary entry provisions for business persons established under the Canada-United States-Mexico Agreement (CUSMA). This agreement reflects a preferential trading relationship between Canada, the U.S., and Mexico, fostering enhanced collaboration and trade opportunities.

Chapter 16 of the CUSMA specifically addresses the temporary entry of certain business individuals, ensuring that their presence in Canada is for temporary purposes and does not involve the establishment of permanent residence.

 

Key Provisions and Benefits:

  1. To benefit from the temporary entry provisions, individuals must hold citizenship in either the United States or Mexico.
  2. Individuals seeking temporary entry must possess the necessary qualifications to work in the profession, which typically include a degree or certification from a related educational program.
  3. Successful candidates must secure pre-arranged employment with a Canadian employer in their respective field of expertise.
  4. The temporary entry is granted to business persons who will provide professional-level services within the field of their qualification, as specified in the CUSMA’s Appendix.
  5. Applicants must adhere to the existing immigration requirements for temporary entry, ensuring compliance with relevant regulations.

ICT – Intra - Company Transfers

This is to provide you with a comprehensive understanding of the work permit eligibility criteria applicable to intra-company transferees under the general provision. This provision enables eligible individuals to apply for work permits based on specific qualifications and conditions, promoting seamless intra-company mobility while adhering to established regulations.

 

Key Eligibility Criteria:

  1. Intra-company transferees seeking entry to Canada for work purposes must currently be employed by a multi-national company. They should intend to work in a parent, subsidiary, branch, or affiliate of that enterprise.
  2. The transferee must be transferring to an enterprise with a qualifying relationship to the employer company.
  3. The transferee should be assuming a position that falls within an executive, senior managerial, or specialized knowledge capacity within the recipient enterprise.
  4. Applicants must demonstrate continuous employment by the employer company, either through payroll records or direct contracts, for a period of at least one year within the three-year period immediately preceding the initial application date.
  5. While the standard work permit limit may range from five to seven years, documented time spent outside of Canada during the work permit’s duration can be recaptured.
  6. This process includes proof of current employment, qualifying relationships between companies, job descriptions, and other relevant information.

Processing Fees:

  1. Employer Compliance Fee:  $230 CAD.

  2. Work Permit Fee:  $155 CAD.
  3. Biometrics Fee $85 CAD
  4. Family Applying Together: $170 CAD (for two or more family members applying at the same time and place).

Business Visitors

  1. Business visitors must substantiate that their primary source of income and principal place of business are located outside of Canada.

  3. Engage in international business activities without becoming part of the Canadian labour market.
  4. Temporarily visit Canada to:
    • Explore opportunities to expand your business.
    • Make investments.

    • Business visitors may remain in Canada for a brief period, up to a maximum of six months.

Application fee and biometric information:

  1. Application Fee: $100 CAD.
  2. Biometric Information Fee (if applicable): $85 CAD.
  3. Total Application Cost (including biometrics): $185 CAD.
  4. If your visa is approved, then you will have to pay for the passport processing, which costs around $45 CAD.

Eligibility Criteria:

  1. Candidates should possess relevant Canadian work experience in specified industries and occupations.
  2. A bona fide job offer from a Canadian employer in the agri-food sector is required.
  3. Meeting or surpassing the stipulated language proficiency requirements is essential.
  4. Meeting or exceeding the educational criteria outlined for the program.
  5. Applicants need to demonstrate sufficient financial resources to settle in Canada, as applicable.
  6. Maintaining temporary resident status, if already residing in Canada, is necessary.

Processing Fees:

  1. Your application : Processing fee ($850) and right of permanent residence fee ($515) Total $1365 CAD.
